How Can a Brevard County Real Estate Agent Use AI for Listings and Ads Without Fair Housing Problems?

Use AI to draft, never to decide who sees an ad or who a home is "for." The Fair Housing Act bars housing ads that show a preference or limit based on a protected characteristic. HUD withdrew its 2024 digital-advertising guidance in 2025, but the Act's ad rule still applies. Review every AI draft and ad setting before it runs.

What does the Fair Housing Act cover in advertising?

Section 3604(c) of the Fair Housing Act makes it unlawful to make, print, or publish any notice, statement, or advertisement about the sale or rental of a dwelling that indicates a preference, limitation, or discrimination based on race, color, religion, sex, handicap (disability), familial status, or national origin. The Act has some exemptions (sections 3603(b) and 3607), so ask your broker or attorney how it applies to you.

What happened to HUD's AI ad guidance?

In April 2024, HUD issued guidance on applying the Fair Housing Act to ads on digital platforms, including automated targeting and delivery. HUD withdrew that guidance effective September 17, 2025, and a Federal Register notice published April 6, 2026 says it should not be relied on as authoritative. HUD says the withdrawal is not necessarily final. The withdrawal does not change the statute: an ad that indicates a preference or limitation is still covered by section 3604(c). Whether ad targeting or delivery choices create liability is a question for your attorney.

How big is the field here?

Census data for 2023 lists 444 offices of real estate agents and brokers in Brevard County, and 422 of them have fewer than five employees. Most are small shops that write their own ads.

What should you do, step by step?

  1. Tell the ad platform when an ad is housing-related, and follow its housing-ad process.
  2. Describe the property, not the people it is "perfect for." (This is a plain-language reading of the rule, not a HUD quote.)
  3. Review every AI draft for phrases that point at a group or exclude one.
  4. Do not target by protected traits or close stand-ins for them. (A cautious practice, not a quote from a current HUD rule.)
  5. Check any custom audience list for who is on it, and who is missing.
  6. Check campaign results where the platform allows it.
  7. Keep a record of drafts, edits, and ad settings.

What about your Google profile?

Google treats real estate agents as individual practitioners. A practitioner may have a profile if the role is public-facing and they can be contacted at the verified location during stated hours. Google says a practitioner should not have multiple profiles for different specializations. Sales or lead-generation agents for corporations are not individual practitioners and are not eligible.

Do Don't
Describe size, features, and location Describe who "would love" the home
Run housing ads through the housing process Skip the platform's housing flag
Edit AI text yourself Paste AI output straight into an MLS or ad

What this won't do

This post is not legal advice. It does not cover Florida Real Estate Commission advertising rules, brokerage policies, or MLS rules, which this post did not check. AI will not close sales or guarantee leads.

FAQ

Can I use AI to write listing descriptions?

Yes, as a draft. You are responsible for what you publish. Check it for statements that indicate a preference or limitation.

Is describing a neighborhood as "family friendly" safe?

This post did not verify specific phrases. Describe features such as parks and schools by name, and ask your broker or attorney about wording.

Does HUD's 2024 guidance still apply?

No. HUD withdrew it effective September 17, 2025. The Fair Housing Act's ad provision, section 3604(c), still applies to housing ads.

Can I use a past-client list as a custom audience?

It may be risky if the list is narrow. Review who is on it and who is missing, and ask your broker or attorney. (Caution, not a HUD quote.)
