What Should a Brevard County Gym or Fitness Studio Know About Florida's Health Studio Rules Before Using AI Marketing?
Florida regulates "health studios." The law covers businesses that sell exercise instruction or the right to use exercise equipment or facilities. It requires registration with the state, and the registration number must appear in printed ads, contracts, and publications. AI can draft your marketing, but a person must check it against these rules first.
Who counts as a health studio?
Florida Statute 501.0125 defines a health studio as any person engaged in selling services for instruction, training, or assistance in a program of physical exercise, or the right to use equipment or facilities for exercise. It excludes an individual acting as a personal trainer, defined as someone without an established place of business for conducting exercise, whose equipment use is incidental, and who does not accept payment for services more than 30 days ahead. Section 501.013 lists some exemptions, such as certain nonprofits, dance, aerobics, or martial arts programs with no exercise equipment, and employee-only facilities. They require filing an affidavit with the department. A 2026 amendment (chapter 2026-3, Laws of Florida) revised the section; its current text lets the department exempt other businesses or activities "not in existence as of July 1, 2026." Read the current text before relying on an exemption.
What does registration require?
Section 501.015 says each health studio must:
- Register each business location with the Florida Department of Agriculture and Consumer Services.
- Pay an annual registration fee of $300 per location (at the time of checking).
- File the security required by section 501.016, or qualify for an exemption.
- Post the registration certificate at the front or registration desk.
- Include the registration number in all printed advertisements, contracts, and publications for the location.
Section 501.016 sets the security at a $25,000 bond, or an alternative, for studios that sell contracts, with listed exceptions. Section 501.0125 defines a "reasonable and fair service fee" as no more than 10 percent of the total contract price.
How does this connect to AI marketing?
If AI drafts a flyer, mailer, or contract summary, add the registration number and have a person check the text. This post could not verify whether a website or social post counts as a "publication" under the statute. Ask the state agency or an attorney. Do not let AI invent prices, fees, or cancellation terms.
How big is the fitness field here?
Census 2023 data lists 66 fitness and recreational sports center locations in Brevard County, and 30 of them have fewer than five employees.
What should a studio do, step by step?
- Confirm your status under the definitions above.
- Register and file the security if you are covered.
- Put the registration number on printed ads and contracts.
- Write class schedules on your site, not just in Google hours. Google says businesses with varied schedules, such as classes, shouldn't provide hours.
- Use AI for drafts like class descriptions and newsletters.
- Have staff compare every draft to your contract terms.
- Get consent before texting. See Fruxd's guide on missed-call follow-up for the Florida texting basics.
What this won't do
This post is not legal advice. It does not cover federal subscription rules or local business tax receipts. Section 501.015(7) does say a local business tax receipt for a health studio requires an active state registration certificate. AI cannot promise fitness results, and your marketing should not either.
