Which AI Tools Are Safe to Use With Customer Data? A Checklist for Florida Small Businesses

No AI tool is safe by itself. Safety depends on the plan, settings, contract, and what you paste in. Some business plans say they do not train on your data by default. Even so, keep sensitive details out unless a contract covers them, and know Florida's data security and breach rules.

What does "safe" mean here?

It means you know where customer data goes, who can see it, how long it is kept, and what happens in a breach. Florida's law, Section 501.171, requires businesses that hold personal information to take reasonable measures to protect it.

What does Florida count as personal information?

A first name or initial and last name plus any of these: Social Security number, driver license or ID number, financial account or card number with its access code, medical history or treatment, health insurance number, biometric data, or geolocation. An email or username with a password also counts.

How do you check an AI tool?

  1. List what customer data you handle. Sort it into red, yellow, and green (below).
  2. Use a business plan, not a personal account. Look for admin controls and multi-factor authentication.
  3. Read the vendor's data page. Look for statements on training, retention, encryption, and contracts.
  4. Turn on multi-factor authentication.
  5. Use placeholders. Write "[Customer A]" instead of real names.
  6. Write a one-page staff rule. Say which tools are approved and which data never goes in.
  7. Keep a vendor list with the plan, owner, and date checked.
Data Example Guidance
Red SSN, ID number, card plus code, medical details, passwords Keep out unless a contract and your counsel approve it
Yellow Names, phone numbers, addresses Use business-tier tools, minimum necessary
Green Public info, generic templates Fine in approved tools

What does one vendor say?

OpenAI's business data page says it does not use data from ChatGPT Enterprise, ChatGPT Business, ChatGPT Edu, ChatGPT for Healthcare, ChatGPT for Teachers, or its API for training by default. It says data is encrypted at rest and in transit and that a Business Associate Agreement is available for ChatGPT for Healthcare and API healthcare customers. That page covers business and API products. Check any vendor's terms for free or personal plans separately.

What if there is a breach?

Under Section 501.171, a covered business must notify affected individuals no later than 30 days after determining a breach. It must also notify Florida's Department of Legal Affairs within 30 days if 500 or more Floridians are affected. A vendor that holds your data must tell you within 10 days.

What this won't do

A vendor's page is a statement, not a guarantee. Regulated work (patient, legal, tax) carries more rules. This is not legal advice.

FAQ

Is ChatGPT safe for customer data?

OpenAI says its business and API products do not train on your data by default. Personal and free plans have separate terms that this post did not check, so read them before using one for work.

Do I need a lawyer to pick an AI tool?

Not for low-risk tasks. For regulated or sensitive data, yes.

Can I put customer emails into AI to write replies?

Use a business plan and share the minimum. Remove names and numbers when you can.

Who is responsible if my vendor is breached?

Under the Florida statute, you still owe notice to affected people once the vendor tells you.
